Terms and Conditions of Use for Inkygoodness LTD

NOTICE: These Terms and Conditions of Use are legally binding. It is your responsibility to read these Terms and Conditions of Use carefully prior to purchase, use or access of any of our products, including online courses. These Terms and Conditions apply to all Inkygoodness LTD Membership and Online Courses, including Make Your Mark Bootcamp, 21 Day Portfolio Boost Challenge, The Editorial Illustrator’s Playbook and Inkygoodness Pro Membership.

TERMS OF SITE & COURSE ACCESS AND PRODUCT PURCHASER AGREEMENT

All programmes, products, courses, digital downloads, membership areas, workshops, and services (the “Offering”) are owned and provided by Inkygoodness Ltd (“Company”, “we”, “us”, or “our”). The terms “you” or “your” refer to any user, participant, member, or purchaser of any Offering.

By accessing or purchasing any of our Offerings, visiting our website(s), or using our community spaces, you are agreeing to the terms set out below. If you do not agree to these terms, please email us at hello@inkygoodness.com and we will make reasonable efforts to remove your details and access.

We may update these Terms from time to time. When we do, we’ll update the date above. Your continued use of our site or access to our Offerings means you accept the updated version.

1. General Provisions

This website and our related social platforms are owned and operated by Inkygoodness Ltd, a UK-based company registered in England & Wales. Company Registration 12201825.

You use this website and our platforms at your own risk. We host our content on reputable platforms and we take reasonable steps to keep things secure and running, but we can’t guarantee uninterrupted, error-free, or risk-free use.

We may change, update, or remove parts of the site or these Terms at any time.


2. Your Use of Our Products, Courses & Membership

When you purchased, joined, or opted in for one of our Offerings, you were shown or had access to these Terms. By going ahead with your purchase or sign-up, you agreed to them.

You confirm that you are at least 18 years old (or the age of digital consent in your country) to purchase or access our Offerings. If you are under 18, you must have a parent or guardian purchase on your behalf and hold the account.

If we discover that someone under the required age is accessing our content without consent, we reserve the right to terminate access.


3. Our Intellectual Property

Everything we create for our courses, memberships, events, and digital products is protected. That includes:

  • course videos and replays

  • workbooks, templates, and resources

  • brand assets, layouts, and graphics

  • written content, session recaps, and guides

  • logos, taglines, and visual identity

  • our platform layout and look & feel

All of the above are the intellectual property of Inkygoodness Ltd (or used by us under licence).

What you can do:

  • Access the Offering you purchased for your own personal and business development.

  • Download and print materials for your own use.

  • Reference us, quote us, or share a small portion of our content with clear credit to Inkygoodness, including a link back to the original source where possible.

What you can’t do:

  • Share your login or give your purchased materials to someone who hasn’t bought them.

  • Re-sell, upload, or publish our course content elsewhere.

  • Copy or “repackage” our workbooks, modules, or community materials as your own.

  • Remove our branding or copyright notices.

  • Create derivative products, courses, or trainings from our materials without written permission.

  • Use any of our content, videos, sessions, or live call replays in a way that competes with us.

If your team or studio needs access, each person must purchase or be granted access separately.

If you’d like to feature, publish, or collaborate using our content, email hello@inkygoodness.com to request written permission.


4. Limited Licence

When you buy from us, you’re not buying the IP — you’re buying a licence to use the content.

That licence is:

  • non-transferable (you can’t sell or give it to someone else)

  • non-exclusive (we can sell to others)

  • revocable (we can remove access if you breach these terms)

  • for your personal / internal business use only

If you use our content outside this licence, we may pursue legal or financial remedies.


5. Content You Share With Us (Course & Community Areas)

If you share content, artwork, testimonials, wins, or submissions inside our platforms, community spaces, or live calls, you confirm you own the rights to what you submit.

By posting or submitting content in our community, you give us a non-exclusive, royalty-free licence to share, celebrate, and promote your work in reasonable ways connected to Inkygoodness (for example: highlighting a member win, showcasing student work, or promoting the programme). We will always aim to credit you.

We are not required to notify you each time we feature content submitted inside the community, but we will act reasonably.


6. Security

You are responsible for keeping your login details secure. If we see suspicious activity (like multiple IPs, shared logins, or mass downloads), we may pause or revoke access.

We do not store full payment details; payments are processed through third-party platforms (such as Stripe, PayPal, SamCart). By purchasing, you agree to their terms.


7. Confidentiality

Unless we have a separate written agreement, nothing you send us via email, contact forms, comments, or social DMs is confidential. Please don’t share sensitive information through those channels.


8. Assumption of Risk

Our courses, resources, and sessions are for educational and informational purposes. You acknowledge that any actions you take based on our content are your responsibility.

We can’t and don’t guarantee any particular financial or career result, client outcome, or number of commissions. Your results depend on your work, portfolio, niche, experience, and external factors.


9. Community Conduct

If you post inside our community areas (Inkygoodness Collective, programme spaces, Zoom calls, or comments), you agree not to post anything:

  • defamatory, abusive, or harmful

  • spammy or misleading

  • that breaches someone else’s IP

  • that promotes illegal activity

  • that is intentionally disruptive to members

We may remove posts or revoke access if your behaviour is harmful to the community or brand.


10. Disclaimers

Our Offerings are provided “as is”.

We do not make guarantees about:

  • getting hired or commissioned

  • making a certain amount of money

  • getting an agent

  • being featured or licensed

  • being accepted to a programme or residency

If you need professional help (legal, tax, financial, medical), please speak to an appropriate professional. We are not providing those services.

We try to keep our materials current, but things change — platforms, laws, tools, pricing, and industry standards. We can’t promise every piece of content will always be fully up to date.


11. Earnings & Results Disclaimer

We sometimes share student wins, case studies, or success stories. These are illustrative, not guaranteed outcomes.

Your results will vary.


12. Technology / Platform Access

We make reasonable efforts to provide access to our content through our chosen platforms (e.g. Inkygoodness Collective (hosted on Mighty Networks), Instagram or similar). Sometimes technology breaks, platforms update, or the internet misbehaves. Where issues are outside our control, we’re not liable for interruptions.

If the platform we use changes or discontinues, we reserve the right to move content to a different platform.


13. Payments, Refunds & Collections

We value your investment — and we invest a lot in developing, delivering, and hosting our programmes.

Payment Plans
If you choose a payment plan, you are agreeing to pay the full amount of the plan. Payment plans are not “cancel any time” unless explicitly stated.

Late Payments
If a payment fails, we may reattempt collection and/or temporarily suspend access until payment is made.

If payment remains outstanding after a reasonable period, we may refer the matter to collections and you may be responsible for any additional fees incurred in collecting the debt.

Refunds

  • Some of our courses and digital products come with a clearly stated refund window (e.g. 3-5 days) — it will be stated on the sales page at the time of purchase.

  • To request a refund within the stated window, email hello@inkygoodness.com before the deadline, including your name, email, and order details.

  • After the refund window closes, all payments are non-refundable, and you are responsible for completing any remaining payments on your plan.

We reserve the right to refuse refunds if:

  • you downloaded content or accessed the course,

  • you shared materials with others,

  • or we believe the policy is being abused.

Courses and Programmes are typically non-refundable once the billing period has begun, but you may cancel future membership renewals in line with the terms at purchase.


14. Chargebacks

By purchasing from us, you agree to contact us first if there is an issue with your order or access.

If you initiate an unmerited chargeback, we reserve the right to revoke access to all current and future Offerings and present evidence of your purchase and access to our payment processor.


15. Revoking Access

We may suspend or terminate your access — without refund — if:

  • you breach these Terms,

  • you share or sell our materials,

  • you are abusive to staff or members,

  • you act in a way that damages our brand or community.

We also reserve the right to block IPs or emails to protect our content.

You may request to cancel your programme access at any time by emailing hello@inkygoodness.com. Cancellation does not void outstanding payments.


16. Dispute Resolution & Non-Disparagement

If something’s not right, we ask that you contact us first so we can try to resolve it informally.

You agree not to publicly defame, slander, or disparage Inkygoodness Ltd, our team, our partners, or our members. Fair, honest reviews and feedback are welcome — targeted, harmful, or false statements are not.


17. Affiliates

From time to time, we may recommend tools, services, or platforms using an affiliate link. That means we may earn a small commission — at no extra cost to you. You accept responsibility for your own purchases from third parties.


18. Privacy Policy

We respect your privacy. We collect and process data to:

  • deliver what you purchased,

  • communicate with you,

  • improve our services,

  • send you relevant marketing (you can opt out),

  • comply with legal obligations.

We may collect:

  • personal data (name, email, billing address)

  • usage data (IP, pages visited)

  • payment-related data (processed by third parties like Stripe/PayPal)

  • social data (if you connect via social platforms)

We may share data with third-party service providers who help us run our business (email providers, payment processors, course platforms). We do not sell your personal data.

If you are in the UK or EU/EEA, we will process your data in line with UK GDPR / GDPR legitimate interest grounds where applicable.

You can request to access, update, or delete your data by emailing hello@inkygoodness.com. Some data may need to be retained for legal, security, or accounting reasons.


19. Data, Cookies & Analytics

We may use cookies and analytics tools (such as Google Analytics, Meta pixels, or similar) to understand how our site is used and to improve your experience. You can disable cookies in your browser, but some parts of the site may not work properly.


20. International Users

Our platforms and tech providers may host or process data outside your country. By using our site or purchasing from us, you consent to this transfer.


21. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages arising out of your use of our site or Offerings.

  • Our total liability to you shall not exceed the amount you paid to us for the Offering, or £100, whichever is lower.

  • You agree to indemnify and hold us harmless from any claims arising from your use or misuse of our content.


22. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes that cannot be resolved informally will be brought in the courts of England and Wales.


23. Severability

If any part of these Terms is found to be invalid or unenforceable, the rest still applies.
